CONSTITUTION OF INDEF

1.NAME:

The name of the Federation shall be “ Indian Engineers Federation’(INDEF) hereafter referred to as ‘Federation’.

2.OFFICE:

The Head Quarter of the Federation shall be at Delhi. The Constituent association unit office of the Secretary General’s State/Organisation shall be utilized for day to day functioning of INDEF.

3. AIMS AND OBJECTIVES

The aims and objectives of the Federation shall be:
a) To organize a united body of Graduate Engineers of the Country and foster a spirit of co-operation amongst them.
b) To safeguard and promote the interest and rights of members of constituent units in all matters, specially relating to their emoluments, service conditions and promotion by all constitutional and legitimate , including legal means.
c) To organize all such activities which will be helpful in the economic, social and cultural upliftment of the members of the constituent units and for the development of the Country.
d) To achieve due and rightful place for graduate Engineers in the Administration and in the Society.
e) To federate with or affiliate itself to any Engineering or Technical organisation with similar aims and objectives.
f) To improve the professional status and the prestige that the members of the constituent units possess in the departments.
g) To ensure equality of rights and privileges for the members of the constituents in State, Central Governments and undertakings irrespective of caste and sex.
h) To publish an official Journal to further its objectives.
i) To consider and express its views on all questions and laws of India or proposed legislation relating to the Graduate Engineers and Engineering Education and initiate or watch over or take such steps and adopt such measures from time to time regarding the same as decided by the Federal Council.
j) To do all such acts as may be necessary for or conducive to the fulfillment of the objectives herein mentioned and as decided by the Federal council from time to time.

4. MEMBERSHIP

a) The Federation shall be the apex body of all associations of Graduate Engineers in the service of the various States and Central Government, quasi Government organizations and Government undertakings.
b) The Federation shall have 6(six) constituent units named as regional Federations. The Jurisdiction and details of these regional federations shall be as follows:
i) Eastern Regional federation of State Engineering services Associations representing West Bengal, Bihar, Jharkhand, Odisha and Andaman & Nicober U.T. It will be named as INDEF (Eastern Region) mwith head quarter at Patna, Bihar.
ii) North-Eastern Regional federation of State Engineering services Associations representing Assam, Tripura, Meghalaya, Nagaland, Manipur, Mizoram, Arunachal Pradesh and Sikkim. It will be named as INDEF (North- Eastern Region) with head quarter at Guwahati, Assam.
iii) Western Regional federation of State Engineering services Associations representing Maharashtra, Gujarat, Madhya Pradesh, Chattishgarh and Goa. It will be named as INDEF (Western Region) with head quarter at Mumbai, Maharashtra.
iv) Southern Regional federation of State Engineering services Associations representing Karnataka, Andhra Pradesh, Telengana, Tamilnadu, Kerala and Puducherry U.T. It will be named as INDEF( Southern Region) with head quarter at Hyderabad, Telangana.

v) Northern Regional federation of State Engineering services Associations representing Uttar Pradesh, Uttarakhand, Delhi, Rajasthan, Punjab, Haryana, Himachal Pradesh, Jammu & Kashmir ,Chandigarh & Laddak U.T. It will be named as INDEF( Northern Region) with head quarter at Lucknow, Uttar Pradesh.

i) Central Regional federation of Central Engineering services Associations representing CPWD, CWC &CEA, AIR & Doordarshan, ITS, Defence Service, Railways,MoRTH,IRRS and other a like Central Engineering services associations. It will be named as INDEF (Central Region) with head quarter at New Delhi.
c) All Engineering services Associations shall federate with Regional Federations of their respective regions and jurisdiction. These Associations and Regional Federations, thus formed shall be the Constituent units of INDEF.
d) All the Associations & Six regional Federations shall become members of the Federation on submitting the application and on payment of necessary fees and subscription and acceptance of Rules and Constitution of Federation as will be in force time to time.
e) The Executive Council of the Federation shall have the authority of accepting or rejecting any application for the membership of Federation.
f) Unless otherwise stated it shall mean as follows:
i) Federation: Indian Engineers’ Federation(INDEF)

5. ADMISSION FEES/ SUBSCRIPTION/FUND

a) The admission fee for the membership of the Federation shall be Rs. 2,000/-(Rupees Two Thousand) only from State/ Central associations. Further there shall be yearly membership subscription of Rs. 5,000/-(Rupees Five thousand) only for each State/ Central Associations.
b) The Constituent unit shall cease to be the member of the Federation in case it is in arrear of the yearly subscription for two consecutive years. Such Constituent associations may be re-admitted on payment of Rs. 100.00 in addition to the amount outstanding in its name.
c) The Federation shall also raise funds in such manner as the Executive Council thinks fit. It can collect special contributions and donations for the purpose of Federation.

6. MEMBERSHIP REGISTER

A register of the constituent units of the Federation shall be maintained in the head office.

7. ORGANISATION

A. FEDERAL COUNCIL

a) The Federal Council of Federation will consist of:
Members of Federal Council
i) Immediate Past Chairman & Immediate Past Secretary General of INDEF
ii) President & Secretary General of six Regional Federation units.
iii) President, General Secretary & Five other members from each state unit duly recommended by the Constituent State unit Associations. In case of Central Engineering Services, each service organizations shall be represented by it’s President, General Secretary & five other members duly recommended by the associations.
b) Each Constituent unit will send the names of members for Federal Council at least 15(fifteen) days prior the date of Bi-ennial Council meeting, when the election will be held i.e. January/February of every Even year. These names will be declared in the Bi ennial general session and the Federal Council shall deemed to be constituted. The Federal Council, so constituted will function till constitution of next Council. It is for2(Two) years.                                                                                                                                                                                                  Members of Federal council shall be entitled to attend and Vote in the meeting of Federal Council. They shall also be en titled to appoint, through a written authority, another member of the constituent unit as hisproxy to vote for him on a poll.

B. EXECUTIVE COUNCIL

a)The Executive Council of the Federation shall consist of:

vii)Ex-Officio Members :                        14( Immediate Past Chairman & Immediate Past Secretary General of INDEF
                                                                     & also the President & Secretary General of six Regional Federations).
b) Executive Council shall be elected in the Bi-ennial general meeting of INDEF of Federal Council in Jan/Feb of every Even year from amongst the members of Federal Council. If any Executive Council Member retires from service during tenure of Council, this position will be treated as vacant on the day of retirement & such vacancy will be filled up by co-option by the Chairman in consultation with the Executive Council. In case of vacancy of Chairman, the vacancy will be filled up by co-option by the Secretary General in consultation with the Executive Council. The New Office bearer( 20 Nos) of INDEF are to be elected from the Federal Council Members from State/ Central Associations. The office bearer of Regional Federation shall not be selected as Office bearer of INDEF National body. The Secretary(Admn) & Secretary(Finance) will be elected from the State /Central organization of the Secretary General & the Secretary(Co-ordination) will be elected from the State/Central organization of the Chairman.
c) Chairman & Secretary General shall not be re-elected. However, he/she may be elected after an interval of one session

8. FUNCTIONS

A. Federal Council

i) To discuss all matters placed before it by the Executive Council and the subjects brought by an constituent unit provided notices of them have been served to the Federation 30 days before the date of the Federal Council meeting.
ii) To frame rules and regulation of the Federation in consonance with the aims and objectives of the Federation.
iii) To discuss the policy matters and chalk out plans of working and movements for the proper function of the Federation.
iv) To hear appeals, if any, filed by the constituent units and disposal.
v) To elect Executive Council.

B. Executive Council

i) General management of Federation.
ii) To carry out the decisions of the Federal Council according to the rules and regulations of the Federation
in consonance with the Constitution.
iii) To deal with all problems faced by the Constituent units.
iv) To organize all such activities and do all such acts as may be necessary for or conducive to the Fulfillment of the objective of Federation.

9. MEETING

A. Federal Council

a) General session: Federal Council shall ordinarily meet once in every year in January/February giving at least 30 days notice in consultation with Chairman by the Secretary General. This session shall help to transact the following business in addition to normal functions. The meeting will be called as Annual Council meeting to be held in every January/ February with the following agenda:
              i) To readout minutes of last meeting, confirmation & action taken
             ii) To consider and adopt the activity report and audited accounts.
             iii) To consider and adopt any amendment of the constitution.
           iv) To consider and adopt the resolutions as submitted by the constituent units. In addition, the new Executive council is to be elected during the bi-ennial council meeting.

B. Special Meetings

i) A special meeting of the Federal Council may be held by giving notice at least 30 days in advance with the agenda in order to exercise the functions, there of, when the exercise of such functions, is urgently required. The notice for the same shall be given by the Secretary General in consultation with the Chairman.
ii) Special meeting may also be called on receipt of requisition from at least half constituent associations or half of members of Federal Council with a specific agenda. The Secretary General will issue guidelines for special meetings.

C. QUORUM

The quorum for these meetings shall be the one-fourth of the constituent associations or the federal council strength. The adjourned meeting will not need any quorum.

10. EXECUTIVE COUNCIL

a) The Executive Council shall meet at least twice in a year. Once during annual Council meeting in January/February & another in July/August in Mid term Council Meeting. At least 30 days notice for the same shall be given by the Secretary General in consultation with the Chairman.
b) A special meeting of the Executive Council may be held at any time by giving notice at least 15 days in advance with the agendam by the Secretary General. Special meeting may also be called on receipt requisition from at least half of the members of Executive Council.
c) The quorum for these meetings shall be one-fourth of Executive Council strength.

11. POWER & DUTIES

A. Executive Council

i) The Executive Council shall manage and conduct all the affairs of Federation and shall be responsible to the Federal Council.
ii) The Executive Council shall have right to form one or more sub committees for carrying out various functions of the Federation.
iii) The Executive Council shall have right to raise and spend available funds in such a manner it deems fit. It may frame rules and regulations, for governing the funds of the Federation and shall be empowered to authorize the office bearers to meet its expenses from the funds.
iv) The executive Council shall have right to establish offices, procure materials for smooth operations and appoint, punish, terminate the employees to carry out the business of the Federation.
v) The Executive Council shall be empowered to fill up any vacancy in the Executive Council.

B. Chairman

i) He shall exercise general supervision over the affairs of the Federation and shall preside over all meetings of the Executive Council, Federal Council and conferences, preserve order and sign minutes of meeting.
ii) He shall approve the agenda programme of meetings of Executive Council and Federal Council.

C. Vice Chairman

He shall assist the Chairman and shall act for him in his absence.

A. Secretary General

i) He shall be responsible for proper execution of decisions, policies and programmes adopted by the Executive Council and Federal Council.
ii) In absence of decisions of the Executive Council, he in consultation with Chairman, shall device ways and means for implementation and materialization of the aims and objectives of the Federation subject to ratification by the Executive Council.
iii) He shall maintain offices and records of the Federation.
iv) He shall record minutes of meetings of Executive Council, Federal Council and any other meeting of the Federation. He shall call meetings of the Executive Council and Federal Council in consultation with the Chairman.
v) He shall carry out other duties as may be entrusted to him by the Executive Council and the Chairman.
vi) He shall be empowered to create and maintain infrastructure for establishment and running of the office and business of Federation in consultation with the Chairman to be ratified by the Executive Council.
vii) He shall be empowered to incur expenditure while discharging of duties of Federation .

B. Secretary(Finance)

He shall maintain the accounts of the Federation, drive and collect amounts due, issue receipts and make payments on voucher and submit the statement of audited accounts and also budget estimate for the coming year with clear propositions which shall be approved by the Executive Council.

12. FUNDS

a) The amounts received by way of admission fee, subscription, contribution and donation shall form general fund of the Federation.
b) The funds of the Federation shall be kept in a Nationalized Bank, at Delhi or at any other place as decided by the Executive Council but preferably in the State of the Secretary General.
c) The account of Federation shall be operated jointly by the Secretary General & Secretary (Finance) as decided by the Executive Council. The Financial year will be November to October.

13. AUDIT

 The chartered accountant for auditing the accounts shall be appointed by the Federal Council during annual council meeting. He shall at the end of every financial year duly check, inspect and audit the accounts and records of the Federation. The financial year will be maintained as November to October & the audit report shall be placed in every annual council meeting.

14. AMENDMENTS TO THE CONSTITUTION

i) The Constitution of the Federation may be modified or otherwise amended by a majority of not lessthan two-third of the Constituent Associations and two-third of the members of the Federal Councilpresent in the general session.
ii) The Constituent units proposing amendment shall submit its proposal to the Secretary General/Chairman well in advance, who will circulate it to all constituent units for their examination and approval. The Constituent units will send their views at the earliest and at least 15 days before the general meeting of the Federal Council. If the amendment is approved by the requisite strength, the Secretary General in consultation with the Chairman shall include it in the agenda to be placed in the general meeting where it may be amended by a majority of Federal Council members present in the meeting as specified.

CONSTITUTION OF REGIONAL FEDERATIONS OF
INDEF

1. NAME AND HEAD QUARTERS

The Regional Federations shall be called as Regional Federation of State/Central Engineering services Associations. It will be named as INDEF( Eastern Region) with head quarter at Patna, Bihar ; INDEF(North- Eastern Region) with head quarter at Guwahati,Assam ; INDEF( Western Region) with head quarter at Mumbai, Maharashtra ; INDEF( Southern Region) with head quarter at Hyderabad, Telangana ; INDEF( Northern Region) with head quarter at Lucnow, Uttar Pradesh & INDEF( Central Region) with head quarter at New Delhi.
1.2 The Constituent association unit office of the Secretary General’s State/Organisation shall be utilized for day to day functioning of the concern Regional Federation of INDEF.

2. AIMS AND OBJECTS OF REGIONAL FEDERATION

To raise status of Engineers.
To provide forum for formulation of guidelines for the coordinated development of the respective regions.
To co-ordinate between INDEF central body and State/ Central constituent associations.

3. CONSTITUENTS AND MEMBERSHIP

The State/ Central Engineering services Associations unit under their region will be constituent of Regional Federation. It will be as follows:
i) Eastern Regional federation of State Engineering services Associations representing West Bengal, Bihar, Jharkhand, Odisha and Andaman & Nicober U.T. It will be named as INDEF (Eastern Region) with head quarter at Patna, Bihar.
ii) North-Eastern Regional federation of State Engineering services Associations representing Assam, Tripura, Meghalaya, Nagaland, Manipur, Mizoram, Arunachal Pradesh and Sikkim. It will be named as INDEF(North- Eastern Region) with head quarter at Guwahati, Assam.

v)Northern Regional federation of State Engineering services Associations representing Uttar Pradesh, Uttarakhand, Delhi, Rajasthan, Punjab, Haryana, Himachal Pradesh, Jammu & Kashmir,Chandigarh Laddak U.T. It will be named as INDEF( Northern Region) with head quarter at Lucknow, Uttar Pradesh.
vi) Central Regional federation of Central Engineering services Associations representing CPWD, CWC & CEA, AIR & Doordarshan, ITS, Defence Service, Railways, MoRTH, IRRS and other a like Central Engineering services associations. . It will be named as INDEF( Central Region) with head quarter at New Delhi.

4. FEDERAL COUNCIL AND THE EXECUTIVE COUNCIL

Policies and the affairs of Regional Federation shall be controlled/ formulated by a body known as Federal Council comprising of following:
i) Immediate Past President & Immediate Past Secretary General of INDEF(Regional Federation)
ii) Chairman & Secretary General of INDEF.
iii) President, General Secretary & Five other members from each state unit duly recommended by the Constituent State unit Associations. In case of Regional Central Engineering Services, each service organizations shall be represented by it’s President, General Secretary & five other members duly recommended by the associations.
4.2 The affairs of Regional Federation shall be managed by the Executive Council comprising of following:

xi) Executive Council Members:             1(One) member from each State/Central associations as recommended by
                                                                  them.(Preferably General Secretary/President of the Association)
xii) Ex-Officio Members                         4(Immediate Past President & Immediate Past Secretary General of  INDEF, Regional Federation &                                                                       also the Chairman & Secretary General of INDEF) 

Chairman & Secretary General shall not be re-elected. However, he/she may be elected after an interval of one session. 

4.3 President

President shall supervise the general affairs and activities of the Regional Federation and preside over the meetings of the Executive Council and Federal Council.

4.4 Vice President

He shall help the President and In the event of absence of the President, he shall act for him.

4.5 Secretary General

The function of the Secretary General will be as follows:
a) He shall be the Chief Executive Officer of Regional Federation
b) He shall act under the direction of the Executive Council and on the advice of the President.
c) He shall prepare reports on the activities of the Federation.
d) He shall convene all the meeting and shall record the minutes of proceeding.
e) He shall perform other duties as assigned to him by the Executive Council.

4.6 Secretary(Finance)

a) He shall maintain the accounts of Regional Federation and make necessary disbursement under the direction of secretary General.
b) He shall operate the Bank account jointly with the Secretary General.
c) He shall keep the regular accounts of receipts and expenditure and get them audited annually by the Chartered Accountant.

4.7 Chartered Accountant shall examine the accounts of the Regional Federation for the year as maintained by the Secretary(Finance) and shall forward the audit repot to the Secretary General for incorporating it in the annual report to be presented to the Council. Financial year shall be maintained as August to July.

4.8 FUNCTION OF EXECUTIVE COUNCIL

i) To see that the rules and regulations of the Regional Federation are properly observed.
ii) To manage and control the business of the Federal Council.

5. FUND

The fund of the Regional federation shall comprise of Admission fee, Annual Subscription from the Constituent and donations .
The admission fee shall be Rs. 1,000/-(One Thousand) only per constituent Associations.
The annual subscription for each constituent associations shall be Rs. 5,000/- per year. The annual subscription shall be payable in advance will due on August of every year.
The rate of annual subscription may be revised, if necessary by the Federal Council.
The Fund shall be deposited in State Bank or any Nationalized Bank of India in a savings bank
account, which will be operated jointly by the Secretary General & Secretary(Finance).

6. ELECTION OF OFFICE BEARERS

The office bearers and members of Executive Council shall be elected by the Federal Council after 2(Two) years in its Biennial Council meeting, from amongst the Federal Council members to be held in October/ November of every Odd year. The President and Secretary General shall not be re-elected.
However, he/she may be elected after interval of one session.
Each Constituent unit will send the names of members for Federal Council at least 15(fifteen) days prior the date of Bi-ennial Council meeting, when the election will be held i.e. October/ November of every Odd year. These names will be declared in the Bi ennial general session and the Federal Council shall deemed to be constituted. The Federal Council, so constituted will function till constitution of next Councul. It is for 2(Two) years.
If any Executive Council Member retires from service during tenure of Council, this position will be treated as vacant on the day of retirement & such vacancy will be filled up by co-option by the Chairman in\ consultation with the Executive Council. In case of vacancy of Chairman, the vacancy will be filled up by co-option by the Secretary General in consultation with the Executive Council.
The New Office bearer( 16 Nos) of INDEF are to be elected from the Federal Council Members from State/ Central Associations. The office bearer of Regional Federation shall not be selected as Office bearer of INDEF National body. The Secretary(Admn) & Secretary(Finance) will be elected from the State /Central organization of the Secretary General & the Secretary(Co-ordination) will be elected from the State/Central organization of the President.
The Chartered Accountant shall be appointed by the Federal Council.
The President and his Executive Council shall hold the office till the day on which they handed over the charge to the new Executive Council.

7. MEETINGS

The Federal Council shall ordinarily meet once in every year. It will be called as Annual Council meeting and to be held in October/November.
The Constituent Associations and the members of the Federal Council shall be informed of the date, venue and agenda of the meeting of the Federal Council at least 30 days in advance.
The Executive Council shall meet at least twice in a year, one during the annual council meeting in October/ November & another in April/May in Mid term Council Meeting.
The Secretary General shall convene the meeting of the Executive Council. A notice consisting the agenda to be discussed at the meeting shall be given to the Members of the Executive Council normally 15 days time in advance.
An extraordinary meeting of the Federal Council may be convened by the Executive Council at the written request of not less than one-fourth of Constituent associations or one-fourth members of the Federal Council.
The quorum of the Annual or Extra ordinary session of the Federal Council and Executive Council shall be at least one-fourth of Constituent associations or one-fourth members of the Federal Council. The adjourned meeting will not need any quorum.
The traveling expenditure of the delegates, office bearers and Executive members for attending the Federal or Executive Council meeting shall normally be met with by their respective Associations. Any Constituent Association failing to pay subscription for consecutive two years, its membership will be ceased. Renewal fees will be Rs. 100/- in addition to the arrears.
